Juicyfitnessnewcastle.com is the website of Juicy Fitness which is the trading name of Juicy Fitness Ltd, 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. These Conditions will apply between you and Juicy Fitness Ltd, when you buy an item from Juicyfitnessnewcastle.com.

The Conditions do not affect the rights you may have under any relevant statutory law.

Your contract for purchases made through Juicyfitnessnewcastle.com is with Juicy Fitness Ltd. You represent and agree that all goods ordered by you are for your own private and domestic use only and are not for resale.

You must be eighteen years old or older to use this site. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.

Juicy Fitness Ltd reserves the right to end our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:

Ordering

When placing an order, you agree that any and all information given is accurate and complete.

All orders are subject to acceptance by us and product availability.

For business purposes, each item requested counts as an individual order. Wherever possible, we will attempt to combine multiple orders in one shipment and on one invoice. Due to business requirements, however, orders may be shipped over several days in multiple packages.

Merchandise available for sale changes on a frequent basis. We reserve the right to make changes in our merchandise without notice. Availability information for products is listed on each individual product description. Some of our products may be available only in limited quantities, so we cannot guarantee that a product displayed on a previous visit to our website may still be available when you visit again. An item may be out of stock temporarily or permanently, or discontinued from our product line. When an item is no longer available, we take reasonable steps to remove it from the website as soon as we can. If you cannot find an item you saw on a previous visit, please notify us, and we will let you know whether we can find the item for you. If Juicyfitnessnewcastle.com does not have stock to deliver the goods you have ordered, we charge your credit or debit card and deliver items when they are back in stock and ready to be shipped.

We take great care to ensure that all information about our products, including prices, set forth on Juicyfitnessnewcastle.com is up-to-date, accurate and reliable. However, there may be occasions when information contained on our site may contain incomplete data, typographical errors, inaccuracies as to merchandise size, price, colour or other matters, or an item that is no longer in stock. We do not warrant that the information accessible via this website is accurate, complete or current. Any errors are unintentional and we apologise if any information on the site is inaccurate. We reserve the right to correct errors and to update product information at any time, including after you have placed your order. We reserve the right to change prices of any product at any time.

The prices displayed on this website are quoted in British currency and are valid only in the United Kingdom. Prices are subject to change at any time. Relevant sales taxes, if any, shall be applied at checkout.

No contract for the sale of any product will exist between you and Juicyfitnessnewcastle.com until we accept your order by shipping the product to you. The price of any item is not guaranteed until the item has been shipped to you. When this happens, we will confirm our acceptance of your order by sending you an email. If the price of a product you have ordered should change prior to shipment, you will be notified by email that your order has not been accepted by us and will not ship. You may re-order the item at the adjusted price if you wish.

This confirmation email will be sent to the email address given in your order form and will detail products ordered, payment method, cost and usual delivery times. You must check that all the details on this confirmation email are correct and contact us as soon as possible if any details are incorrect. If your order has not been accepted, you will receive an explanatory email from us detailing the reasons why.

Payment

Juicyfitnessnewcastle.com accept most major credit/debit cards including: VISA and Mastercard, payments are facilitated by Stripe Inc. We also accept payment via PayPal.

All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. In the event that the items you have ordered are out of stock, your order will be cancelled and you will be refunded immediately.

Gift vouchers can be redeemed online as a method of payment at the checkout. You will need to enter the gift voucher number when prompted during the checkout process. Please note no change will be given when using a gift voucher with a value higher than the order value. Gift vouchers expire after 6 months from issue.

Delivery

The stated delivery period within which you will receive your order is approximate. Goods will be sent to the address given by you in your order. If you are ordering more than one item, your goods may be sent to you in instalments if certain items are out of stock.

Customs Fees - Please note that we ship all orders from the UK. Shipments from the UK to the USA are subject to Federal import regulations which can incur duties and taxes levied as the parcels enter the country. 

Please note international shipments may be subject to cross-border inspections by customs authorities.

Free Delivery/Shipping Codes

• We may from time to time offer free shipping/delivery codes which may apply in respect of any, or certain specified, purchases made though this Website.
• The conditions of use relating to any discount code will be specified at the time of issue.
• Only one promotion code can be used per order unless specified otherwise.
• A promotional code can't be used after an order has been placed.
• Different promotional codes will have different expiration dates, we reserve the right to cancel an offer at any time or extend an offer.
• Different promotional codes will have different usage allowances, we reserve the right to limit usage to one per person.
• Juicy Fitness reserves the right to (i) cancel this offer at any time (ii) refuse to allow any individual to participate in the Offer (iii) decline to accept orders where, in its opinion, an Offer code is invalid for the order being placed and (iiii) amend these terms and conditions (and will use reasonable endeavours to notify changes to all customers).

Law

These terms and conditions shall be governed by and construed in accordance with UK law and exclusive jurisdiction of the English courts in the event of a dispute.

Returns/Exchanges Policy & Cancellation Rights

You can return unworn and unused items* with the original tags intact to us within 14 working days of receiving for a refund. Please be advised that you will not receive a refund for your original shipping costs as this pays for Royal Mail/DPD/DHL to collect your parcel and deliver this to you.

All items will be refunded at the price they were purchased for.

Please include your original invoice or a note with your order details and also the reason for returning within the parcel.

Please allow up to 21 working days from when your return has reached our premises for our team to process it. We, unfortunately, don't send confirmation emails when we receive returns but as soon as yours has been processed you will receive an automatic email. If you have a tracking number for your return and it has been received by us, your return will be in a queue awaiting processing.

We cannot refund or issue store credit for unwanted items after 30 days from receiving your order. We do not offer exchanges, except for exceptional circumstances.

How to Return Your Item

There are two ways you can return items to us, these are listed below. 

Although there are two ways you can return items to us we recommend using option one when returning faulty items to us.

Option One - Returns Using Royal Mail:

We recommend that you use return items using Royal Mails tracking service to keep track of your package.

Please note we can not confirm receipt of your return once it arrives at our premises as we do not scan returned items once they enter our building (however Royal Mail do scan them when they reach us) we advise tracking your return using the tracking number provided to confirm it has reached us. Once we receive your return it will go into a queue. We then open each return in order of date received and process it. You will then receive an automatic email to confirm a refund has been issued. Please rest assured if your return has been tracked and is showing as delivered to us on your tracking, it is in a queue awaiting processing.

Option Two - Return to Local Class

You can return you item to any one of our community based fitness classes. 

All current address and class time can be found on our website. Juicy Fitness Ltd cannot be held responsible for the loss of your return if it is not handed directly to a Juicy Fitness Employee.

Return Conditions:

Please be careful when trying on your items! We cannot accept returns on soiled items. Ensure all tags are intact and the item is in original condition. All goods will be inspected upon return. Any unwanted items must be returned to Juicy Fitness Ltd in a saleable condition. 

Unfortunately, any returns which are found to have make-up stains on the garment cannot be exchanged or refunded. 

The goods are your responsibility until they reach Juicy Fitness Ltd, so please make sure any returns are securely packaged and cannot get damaged on their way back to us. Ensure the return address is clear and cannot be confused with any other address (please cross out any previous addresses that could still be on the packaging).

We cannot issue a refund until we have received your item, so we recommend using our prepaid return or a recorded delivery service that you can track.

We are not responsible for any items that are returned to us by mistake.

Postage costs are non-refundable.Return Faulted Items:

Please note you must inform us of the item fault prior to sending a faulted item back, as we do not refund items without being informed of the faults before we receive them. Please note when returning faulted items to ourselves, this must be done using our TRACKED PREPAID RETURN service via Royal Mail (please see above instructions). We do not cover postage costs for items sent back via Special Delivery/Saturday Delivery etc as they are costlier and not needed when we offer a prepaid service above. 

Please note we do not accept items that have been worn, washed or used for a full refund. All refunds are offered at the discretion of Juicy Fitness Ltd. Juicy Fitness Ltd reserves the right to refuse the refund of any item we suspect has been washed, worn or used.

If You Receive a Faulted Item

On the rare occasion that you receive a faulted item, please ensure that you email Juicyfitness_goodvibesonly@outlook.com prior to sending the item back. Please attach images where possible of the faulted item to any emails sent to us. We can not refund faulted items which we have not been informed about prior to receiving the returns. Juicy Fitness Ltd also reserves the right to refuse to refund a faulted item if we suspect foul play or tampering. We reserve the right not to refund the item if we have not been informed of any faults prior to receiving the item.

Please do not contact the email address or mobile phone number attached to our PayPal account as they are for PayPal use only and any emails/text messages sent to these will not be responded to.

Privacy Policy

We will never ask for personal details via email. If you receive an unsolicited email asking you for your Juicy Fitness log in details, please contact us immediately.

Submissions

We try to respond promptly to email messages from customers and visitors to our site.

However, we are under no obligation to respond to such messages, to maintain such messages in confidence, or to pay for such comments or submissions. Please be advised that all emails, comments, feedback, suggestions, ideas and other information disclosed or submitted to us will become our property. By submitting any email or correspondence to us, you thereby release all proprietary claims and intellectual or other property rights therein.

You agree that we may use and/or disclose information about you, such as demographics or your use of this site, in any way without revealing your personal information or identity. By taking part in promotions, contests or sweepstakes offered on the site, or by requesting promotional information or product updates, you agree that we may use your information for marketing and promotional purposes.

Liability

We do not accept liability (except as set out below) for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on Juicyfitnessnewcastle.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the subject product. You may re-order it if you wish. If you have already paid for the goods in the circumstances described in this clause, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.

In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation email within 10 working days of delivery of the goods plus return the goods to us, unless we inform you that return is not necessary. This provision does not affect your statutory rights.

We have taken great care to provide accurate product images for each product for sale on the site. However, the colours we use, as well as the display and colour capabilities of your particular computer monitor, will affect the colours you actually see on the screen. We are not responsible for the limitations of your monitor and cannot guarantee that your monitor's display of any colour, texture or detail of merchandise will be accurate. If you are not satisfied with your purchase for any reason, you may simply return the product following the provisions set out in these Conditions.

Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from Juicyfitnessnewcastle.com.

We have taken great care to prevent internet fraud and to ensure that any data collected from you is stored securely and safely. However, we cannot be held liable in the unlikely event of a breach in our secure computer servers.

Juicy Fitness's total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Juicy Fitness to the customer.
